2. About These Terms
2.1 These Terms form a legally binding agreement between you and ABEL.
2.2 You accept these Terms by ticking the acceptance box when you create your account. We keep a record of the version you accepted and the date and time of acceptance. If you do not accept these Terms, do not use the Platform.
2.3 These Terms should be read together with our Privacy Policy and our Cancellation and Refund Policy, both available at getabel.app. On cancellations and refunds, the Cancellation and Refund Policy prevails if there is any conflict.
2.4 We recommend that you save or print a copy of these Terms.
3. What ABEL Is — and Is Not
3.1 ABEL is a marketplace. We operate a technology platform that connects customers with independent professionals. We are an intermediary.
3.2 ABEL does not provide the Services. Providers are self-employed contractors — not employees, workers, agents or subcontractors of ABEL.
3.3 The contract for the Services is between you and the Provider. ABEL is not a party to it. Our contract with you covers access to the Platform, the introduction to the Provider, and payment processing.
3.4 We vet Providers before admitting them to the Platform and we operate the ABEL Guarantee (clause 12). We do not supervise or control how a Provider performs the work.
4. Eligibility and Your Account
4.1 To use ABEL you must: (a) be at least 18 years old; (b) have the capacity to enter into a binding contract; (c) be located in a country where ABEL operates; and (d) provide accurate registration information.
4.2 By creating an account you confirm that you meet these requirements. We may ask you to verify your age or identity.
4.3 Keep your login details confidential. You are responsible for all activity under your account. Tell us immediately at info@getabel.app if you suspect unauthorised use.
4.4 One account per person. Creating multiple accounts to claim promotions, referral bonuses or free trials more than once is a breach of these Terms.
5. Making a Booking
5.1 Instant Booking. You select the service, options and address, choose either an exact start time or a flexible time window (clause 5.4), and pay. Your request is then offered to eligible Providers. A Booking is formed only when a Provider accepts your request — not when you submit it, and not when payment is taken.
5.2 Quote Requests. For some Services you describe the work and Providers respond with a price. A Booking is formed when you accept a quote and pay.
5.3 Confirmation. A Booking is confirmed as soon as a Provider accepts it, at the start time shown; no further approval from you is needed. You receive a push notification, an in-app notice and an email telling you who is coming and when.
5.4 Matching and time windows. Your request is sent first to available Providers who offer that Service near you, and then, if none of them accepts within a few minutes, to other available Providers on your island who offer it; the first to accept is allocated your Booking. You may ask for an exact start time, or for a flexible time window: a range of at least 2 hours on one day, any time on one day, or mornings, afternoons and/or evenings on up to 3 days. For a flexible request, the Provider who accepts chooses a start time within your window that leaves enough time to complete the job before the window ends; that becomes the confirmed start time, and we tell you the exact time as soon as they accept. Where we offer a discount for flexible requests, it is shown before you pay and is funded by ABEL. We cannot guarantee a particular Provider unless you use Provider Lock-in (a Membership benefit), and even then that Provider must be available and must accept. If you ask a particular Provider first (when you book again, choose one of your favourite Providers, or for a regular booking under clause 5.9), your request is offered to that Provider alone for up to 2 hours, or until 12 hours before the start if that is sooner; if they decline or do not answer in that time, it is offered to other Providers as described above.
5.5 If no Provider accepts your request, it stays open until 12 hours before the requested start (for a flexible request, the start of your earliest window) or, where that start is within 24 hours of your request, until 1 hour before it. If it is still open halfway to that point, we tell you and suggest other times when Providers are available. If nobody has accepted by then, the request is cancelled automatically, no Booking is formed and you are not charged: any amount taken from your payment method is refunded to it (or the authorisation is released), and any Wallet Credit you used is returned to your Wallet Credit, automatically. You will be notified.
5.6 Access and site conditions. You must ensure that:
(a) the Provider can safely access the property at the agreed time;
(b) the address, access instructions and description of the work are accurate;
(c) utilities reasonably required for the Service (water, electricity, lighting) are available;
(d) you disclose in advance anything affecting safety — pets, hazardous materials, structural defects, restricted access;
(e) valuables and fragile items are secured or removed; and
(f) children and vulnerable persons at the property are supervised by you or another responsible adult.
5.7 If a Provider cannot safely perform the Service because clause 5.6 has not been met, this may be treated as a customer no-show under clause 10.
5.8 Rental properties. If you let a property to guests (for example through Airbnb, Booking.com or Vrbo), you may add it in the app and choose how its cleanings are planned, in any combination:
(a) its calendar (iCal) link, which we check about every 30 minutes;
(b) stays you add yourself, with the checkout time and, if you know it, the next check-in;
(c) a fixed schedule, for example every Saturday from 10:00 to 14:00; and
(d) Clean now, a same-day request you make in the app when a guest has left.
For (a) and (b) we plan a cleaning on each checkout day in the next two weeks, in a window from the checkout time to the next check-in that day (or to 19:00 when nobody arrives); for (c), on each scheduled day. There is at most one cleaning a day: a stay you add comes before your calendar, and your calendar before the schedule. Each cleaning uses the options you set for the property, except that you may choose a different type of clean (for example a deep clean) for stays of at least a number of nights you set; the price of each cleaning is shown in the app and in our notice to you. For cleanings planned under (a) to (c) you choose, for each property:
(e) Ask me first (the default): we send you each cleaning to approve; it is requested only when you approve it. We remind you about 24 hours and about 4 hours before its window (the second reminder at 21:00 the evening before if it would otherwise fall at night). A cleaning you have not approved at least 1 hour before its window is not requested, and we tell you so. These messages come as notifications in the app, or by email if a notification cannot reach you (for example, because notifications are switched off on your phone); or
(f) Book automatically: we request each cleaning as soon as it is planned. You switch this on only by expressly agreeing to automatic bookings and charges in the app, and you can switch it off at any time; it then applies to cleanings planned after that.
A cleaning requested this way, including under Clean now, is a request under clause 5.1 and is paid when a Provider accepts it (clause 7.1). We request one only if you have a saved card. If a stay is moved or cancelled in your calendar, or you remove a stay you added, we cancel its cleaning automatically and free of charge, refund anything paid for it to your card, and tell you and the Provider. For a stay that moved, we plan a cleaning for its new date as in (e) or (f): under Ask me first we send it to you to approve, even if you approved the original cleaning; under Book automatically we request it straight away. The same applies if the next guests' arrival changes so that an accepted cleaning no longer fits. You may give the Provider access instructions, a checklist (with reference photographs), a restock list, and whether you or they provide the bed linen and towels; access instructions and the checklist are shown to the Provider only once they have accepted the Booking. A Provider who marks restock items as running low does so for your information only: buying them is up to you. You are responsible for what you give us (the calendar link, stays, schedule and instructions) being right and up to date, and for access to the property (clause 5.6); we are not responsible for cleanings planned from wrong or late information.
5.9 Regular bookings. You may make a Service you have booked regular: every week, every 2 weeks or every 4 weeks, on a day you choose, at an exact time or in a time window. You set this up only by expressly agreeing in the app to the requests and charges it involves. We request each visit 6 days before it, at the price that applies then, and tell you the date and price when we do, including any change from the last visit; each visit is a request under clause 5.1, paid when a Provider accepts it (clause 7.1), and we request one only if you have a saved card. A Provider may agree to be the regular Provider for your booking, in which case each later visit is booked with them automatically at the same time and you are charged at that point. You may skip a visit, pause, change or cancel the regular booking at any time in the app; skipping or cancelling withdraws visits already requested free of charge, unless the visit starts within 1 hour or the Provider has set off, when clause 10 applies. A change of day or time ends any regular Provider arrangement for later visits.
6. Prices, Surge and VAT
6.1 All prices are in Euro (EUR).
6.2 Prices are calculated by ABEL on our servers from the Service, the options selected and any surge multiplier. The price shown on the confirmation screen before you pay is the price you are charged.
6.3 Surge. At times of high demand a multiplier may apply. It is disclosed before you confirm. ABEL Pro members are not charged surge.
6.4 Prices shown on getabel.app are indicative "from" prices for the smallest configuration of a Service. Your actual price is calculated in the app.
6.5 VAT. Prices include Maltese VAT where chargeable.
6.6 We may change prices at any time. Changes do not affect Bookings already confirmed.
6.7 Photo estimates. If you send photos and a description for an estimate, an automated system (using AI) suggests the Service, the options that are likely to apply and a price range calculated from ABEL's own prices. An estimate is not a quote or a price and does not bind you or ABEL: you choose what to book and may change anything; the price you pay is the one shown before you pay (clause 6.2); and your Provider confirms the work on arrival, any change following clause 9. Where an estimate shows safety advice (for example about gas, electricity, water or structural danger), it is general guidance only and is no substitute for the emergency services: in an emergency, call 112.
7. Payment
7.1 Payment is taken when you confirm a request, through our payment provider Stripe, except for a booking paid on acceptance (clauses 5.8 and 5.9): its price is charged to your saved card, without you being present, when a Provider accepts it. If your bank asks you to confirm that payment, or the card is declined, we ask you in the app to confirm it or pay another way; if you have not done so by the time we give (no later than 1 hour before the start), the Booking is cancelled free of charge and the Provider told. ABEL does not store your full card details.
7.2 By providing a payment method you authorise us to charge it for: (a) the Booking Total; (b) any amendment you agree to under clause 9; (c) any cancellation fee; (d) any customer no-show fee; (e) Membership fees, until the Membership is cancelled; and (f) the Booking Total of each booking paid on acceptance (clauses 5.8 and 5.9), when a Provider accepts it or it is booked with your regular Provider, including bookings requested automatically with your agreement.
7.3 If a payment fails or is reversed, we may suspend your account and pursue the amount owed.
7.4 Chargebacks. If you dispute a charge with your bank without first raising it with us, and the charge was validly made, we may suspend your account and recover the amount together with any fees charged to us as a result. Please contact info@getabel.app first — we will almost always resolve it faster.
7.5 Tips. Tips are voluntary, are paid to the Provider in full, and ABEL takes no commission on them. Tips are not refundable once the Booking is complete, unless the Booking itself is refunded.
8. ABEL Wallet Credit
8.1 Wallet Credit may be issued to you as a refund, as compensation, as a Membership benefit, or through the referral programme.
8.2 Wallet Credit is not electronic money and has no cash value. It:
(a) may be used only towards Bookings on the Platform;
(b) cannot be exchanged for cash or paid out to a bank account;
(c) cannot be transferred or sold; and
(d) is personal to your account.
8.3 Wallet Credit does not expire while your account remains open and in good standing. If your account is closed, any remaining Wallet Credit is forfeited — except any portion that represents a refund of money you actually paid, which will be returned to your original payment method on request.
8.4 Wallet Credit is applied to Bookings according to your settings in the app. Any balance not covered by Wallet Credit is charged to your payment method.
8.5 We may withdraw Wallet Credit obtained through fraud, error, abuse of a promotion or breach of these Terms.
9. Changing a Booking (Amendments)
9.1 Either you or the Provider may propose a change to a confirmed Booking — for example where the job turns out to be larger than described.
9.2 No change takes effect unless both you and the Provider accept it. Neither party can change the price unilaterally.
9.3 Where an amendment increases the price, the additional amount is charged once you accept. Where it decreases the price, the difference is returned to your Wallet Credit.
9.4 An amendment request expires if it is not accepted within 10 minutes, and the original Booking continues unchanged.
10. Cancellations, No-Shows and Refunds
10.1 Cancellations, no-shows and refunds are governed by our Cancellation and Refund Policy, which forms part of these Terms.
10.2 In summary:
(a) you may cancel free of charge more than 1 hour before the scheduled start, and, for a flexible request, within 1 hour after a Provider confirms the start time, provided the Provider has not set off;
(b) later cancellations attract a fee of 25%, 50% or 75% of the Booking Total, depending on how far the Provider has progressed;
(c) cancellation fees are paid to the Provider in full — ABEL takes no commission on them;
(d) if a Provider cancels, you receive a full refund plus €5 Wallet Credit;
(e) if you are not present and cannot be reached within 10 minutes of the agreed start, a no-show fee of 75% of the Booking Total applies, paid in full to the Provider.
10.3 A cancellation or no-show fee will never exceed the amount you actually paid for the Booking, whether by payment method or by Wallet Credit.
10.4 Refunds are issued as Wallet Credit rather than to your original payment method, except where the Cancellation and Refund Policy or the law requires otherwise, or where we agree otherwise.
11. Your Right to Cancel Under Consumer Law (Distance Contracts)
This clause sets out rights you have under EU and Maltese consumer law. Nothing in these Terms removes those rights.
11.1 Services. You would ordinarily have 14 days to withdraw from a contract concluded at a distance. However, ABEL Bookings are for services to be performed on a specific date or within a specific period, and contracts of that type are excluded from the statutory right of withdrawal.
11.2 In place of that right, ABEL offers the free cancellation window set out in the Cancellation and Refund Policy, which for most Bookings made shortly before the appointment is more generous than the statutory position.
11.3 Memberships. For a Membership purchased at a distance you do have the right to withdraw within 14 days of purchase.
(a) If you have used no Membership benefit in that period, you receive a full refund to your original payment method.
(b) If you asked us to begin the Membership immediately and then withdraw, we may charge a proportionate amount for the period during which the Membership was active, and for the value of any benefit you have already used (for example monthly Wallet Credit already issued, or surge already waived).
(c) When you start a free trial or activate a Membership, you will be asked to confirm that you want it to begin immediately. By confirming, you expressly request that we begin providing it at once, and you acknowledge paragraph (b).
11.4 To withdraw, contact info@getabel.app. You may use the form in Schedule 1, but you do not have to.
11.5 These rights are additional to your legal rights if a Service is not carried out with reasonable care and skill.
12. The ABEL Guarantee
12.1 If a Service is not carried out to a reasonable standard, report it in the app or to info@getabel.app within 48 hours of completion.
12.2 We investigate — normally by reviewing the before and after photographs, the in-app chat, and the Provider's account of events.
12.3 We may, at our discretion: arrange for the work to be put right, issue partial or full Wallet Credit, or issue a refund.
12.4 The ABEL Guarantee is a voluntary commercial commitment. It is in addition to, and does not limit, your statutory rights, including your rights against the Provider.
13. Reviews and Ratings
13.1 Reviews must be honest and based on your own experience. They must not be unlawful, defamatory, discriminatory or abusive, and must not contain the personal data of third parties.
13.2 We may remove reviews that breach clause 13.1 and may suspend accounts that post fake or malicious reviews.
13.3 We do not remove reviews merely because a Provider disagrees with them.
13.4 Your review, your first name and your general area may be displayed publicly. Do not include anything in a review that you do not want to be public.
13.5 Providers may also rate you. Those ratings are used internally to help Providers decide whether to accept a job, and are not displayed publicly.
14. ABEL Membership
14.1 Memberships (ABEL Plus and ABEL Pro) carry the benefits described in the app at the point of purchase.
14.2 Trial. New members are currently offered a 14-day free trial. Your payment method is collected at sign-up but is not charged until the trial ends. If you do not cancel before the trial ends, the Membership begins and you are charged. The trial length and the exact date of your first charge are shown to you before you confirm, and the date shown at sign-up is the date that applies to you. We may change the trial length offered to new members, but never for a trial that has already started.
14.3 Billing. Memberships renew automatically each billing period until cancelled.
14.4 Cancelling. You may cancel at any time in the app. Cancellation takes effect at the end of the current paid period, and benefits continue until then. We do not refund part-periods except where clause 11.3 or the law requires.
14.5 Price changes. We will give you at least 30 days' notice before any increase in Membership price, and you may cancel before it applies.
14.6 Benefit changes. We may add, change or remove benefits. If we remove or materially reduce a benefit, we will notify you, and you may cancel within 30 days of that notice and receive a pro-rata refund of the current period.
14.7 Benefits are personal to you and to the addresses registered on your account. They may not be shared, sold or transferred except where a benefit expressly permits it (for example, family address sharing on ABEL Pro).
14.8 Benefits marked "coming soon" in the app are not yet available and do not form part of what you are paying for.
15. Promotional Codes, Referrals and Loyalty
15.1 Promotional codes are subject to the conditions stated when they are issued — minimum spend, eligible services, expiry date and usage limits.
15.2 Codes have no cash value, cannot be combined unless expressly stated, and may be withdrawn at any time.
15.3 Referrals. Both the referrer and the person referred may receive Wallet Credit once the person referred completes their first eligible Booking. We may withhold referral credit where we reasonably believe the programme is being abused — for example through self-referral, duplicate accounts, or bulk distribution of codes.
15.4 Loyalty points have no cash value, are personal to your account, are governed by the terms shown in the app, and may be varied or discontinued on reasonable notice. Points earned before a change are honoured.
16. Things You Must Not Do
You must not:
(a) use the Platform for any unlawful purpose;
(b) arrange for a Provider you met through ABEL to carry out work off-platform in order to avoid ABEL's fees, for 12 months after your last Booking with that Provider;
(c) submit false, misleading or malicious reviews;
(d) harass, threaten, discriminate against or abuse a Provider or a member of ABEL's staff;
(e) provide false information, including a false address or a misleading description of the work;
(f) access another user's account, or any part of the Platform you are not authorised to access;
(g) copy, scrape, reverse engineer, or extract the source code or data of the Platform;
(h) introduce malware or interfere with the operation of the Platform;
(i) use the Platform to build a competing product or service; or
(j) resell or commercially exploit access to the Platform.
17. Suspension and Termination
17.1 You may close your account at any time in the app or by emailing info@getabel.app.
17.2 We may suspend or close your account, giving notice where reasonably practicable, if: (a) you breach these Terms; (b) you accumulate three customer no-shows; (c) we reasonably suspect fraud, abuse of a promotion, or unlawful use; (d) an amount owed to us remains unpaid; or (e) we are required to do so by law.
17.3 Where suspension is not urgent, we will tell you the reason and give you an opportunity to respond.
17.4 On closure of your account: confirmed Bookings are completed or cancelled in accordance with the Cancellation and Refund Policy; any Membership ends at the end of the current period; and Wallet Credit is treated in accordance with clause 8.3.
17.5 Survival. Clauses 8.3 (Wallet Credit on closure), 13.4 (reviews remaining public), 18 (liability and indemnity), 21 (intellectual property), 24 (general) and 25 (governing law) continue to apply after your account is closed.
18. Liability
Please read this clause carefully. It limits our liability to you.
18.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot lawfully be excluded or limited; or (d) your statutory rights as a consumer.
18.2 Subject to clause 18.1:
(a) We provide the Platform. We do not perform the Services, and we are not responsible for the acts, omissions, quality of work, punctuality, conduct or legal compliance of any Provider.
(b) Your primary recourse in respect of the Services is against the Provider, who is required to hold public liability insurance. We will help you identify and contact the Provider and, where appropriate, will support a claim under their insurance.
(c) The Platform is provided for domestic and private use. We are not liable for loss of profit, loss of business, business interruption or loss of business opportunity.
(d) We are not liable for indirect or consequential loss.
(e) Our total liability to you in respect of any Booking is limited to the Booking Total for that Booking. Our total liability to you in any 12-month period for all other claims arising from your use of the Platform is limited to the greater of €500 or the total amount you paid to us in that period.
18.3 We do not guarantee that the Platform will be available uninterrupted or error-free, or that a Provider will always be available in your area or at your chosen time.
18.4 Indemnity. You indemnify us against any claim, loss or cost arising from: your breach of these Terms; false information you provide; injury or damage caused by you, or by conditions at your property, to a Provider or their equipment; or your unlawful use of the Platform. This clause does not apply to the extent that the loss was caused by our own breach or negligence, and applies to a consumer only to the extent permitted by law.
19. Force Majeure
Neither party is liable for a failure to perform caused by an event beyond its reasonable control, including extreme weather, natural disaster, fire, flood, epidemic, industrial action, civil unrest, government action, or failure of telecommunications or utilities. Where such an event prevents a Booking from going ahead, the Booking is cancelled and refunded in full, with no cancellation fee to either party.
20. Changes to These Terms
20.1 Where a change to these Terms is material and adverse to you, we will give you at least 30 days' notice by email or in-app notification before it takes effect.
20.2 For a material change, we will ask you to accept the updated Terms in the app before you next make a Booking, and we will keep a record of that acceptance. If you do not accept the change, you may close your account before it takes effect.
20.3 Changes required by law, or which are neutral or favourable to you, may take effect immediately.
21. Intellectual Property
21.1 The ABEL name, logo, applications, website and their content are owned by or licensed to ABEL. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your personal, non-commercial use.
21.2 Content you submit. By submitting reviews, photographs or messages, you grant ABEL a worldwide, non-exclusive, royalty-free licence to host, store, reproduce and display that content for the purpose of operating and improving the Platform, and — with your consent — promoting it. You confirm that you have the right to grant that licence. You retain ownership of your content.
21.3 We may use anonymised and aggregated usage data for any purpose, provided it does not identify you.
22. App Store Terms
22.1 Where you download the app from the Apple App Store or Google Play, you also agree to that store's terms.
22.2 Apple. You acknowledge that: these Terms are between you and ABEL, not Apple; Apple has no obligation to provide maintenance or support for the app; if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the app; Apple is not responsible for investigating or resolving any third-party intellectual property claim relating to the app; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
22.3 You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
23. Complaints and Dispute Resolution
23.1 Contact us first at info@getabel.app. We aim to acknowledge complaints within 2 working hours and to resolve them within 5 working days.
23.2 If we cannot resolve your complaint, as a consumer in Malta you may be able to refer the matter to the Office for Consumer Affairs at the Malta Competition and Consumer Affairs Authority (MCCAA) or to the Consumer Claims Tribunal. Details are available at mccaa.org.mt.
23.3 Nothing in this clause prevents you from bringing court proceedings.
24. General
24.1 Severability. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions continue in force.
24.2 No waiver. If we do not immediately enforce a right, that is not a waiver of it.
24.3 Entire agreement. These Terms, together with the Privacy Policy and the Cancellation and Refund Policy, are the entire agreement between us regarding the Platform. This clause does not limit liability for fraudulent misrepresentation.
24.4 Assignment. You may not transfer your rights under these Terms. We may transfer ours — for example on a sale or restructuring of the business — provided this does not reduce your rights, and we will notify you if we do.
24.5 Third-party rights. Except as stated in clause 22.2 (Apple), no person other than you and ABEL may enforce these Terms.
24.6 Notices and electronic records. We may notify you by email to the address on your account or by in-app notification. Notices to us should be sent to info@getabel.app. You agree that we may communicate with you electronically, and that our electronic records of your acceptance of these Terms, your Bookings and your payments are the record of those matters.
24.7 Language. These Terms are provided in English.
24.8 Interpretation. Headings are for convenience only. "Including" means including without limitation. The singular includes the plural and vice versa.
25. Governing Law and Jurisdiction
25.1 These Terms, and any dispute arising from them, are governed by the laws of Malta.
25.2 The courts of Malta have exclusive jurisdiction. If you are a consumer resident in another EU member state, you retain the protection of the mandatory consumer-protection provisions of the law of your country of residence, and you may also bring proceedings there.
